The Union of Shop Distributive and Allied Workers (USDAW) is bringing employment tribunal proceedings against Deloitte, the receiver for Woolworth, for failing to consult properly over the redundancy of staff affected  by the recent closure  of the business.

Under the Trade Union and Labour Relations Act 1992 employers are required to consult with trade unions or other appointed representatives for a minimum period of 30 days where 20 or more employees are being made redundant. Where 100 or more employees are affected, that period increases to 90 days.

Should a tribunal find in the employee’s favour then they will receive an award of 13 weeks pay each unless there are circumstances justifying awarding a lesser sum
