These Regulations makes amendments to various pieces of existing legislation which are consequential to the Employment Equality (Age) Regulations 2006 (the Age Regs) in particular:
• The Employment Rights Act is amended so that dismissal for exercising or seeking to exercise, the right to be accompanied, or to accompany another, at a meeting under the Age Regs to request working beyond the intended retirement date, will be unfair;
• The Dispute Resolution Regulations are amended so that a complaint under the Age Regs is treated in the same way as complaints under other discrimination legislation. In addition, as with other statutory discrimination questionnaires, an age discrimination questionnaire will not constitute a grievance; and
• The Employment Tribunal Rules of Procedure Regulations are amended so that cases of age discrimination are added to the list of claims which are exempt from the requirement for a fixed 13 week conciliation period.
