The Temporary and Agency Workers (Prevention of Less Favourable Treatment) Bill prohibits the use of direct, but not indirect, discrimination against agency workers, and obliges end users to inform all agency workers under his control of “any vacancies in his organisation”. Interestingly, this is not limited to simply suitable vacancies.
Furthermore, the Regulations provide for joint liability between the agency and the end user.
If the Bill is successful in passing through Parliament, it is anticipated that it will be effective no later than 1 October 2008.
