In what is thought to be the first age discrimination case to go before an employment tribunal, Ann Southcott, a clerical worker at Treliske Hospital in Truro has secured a landmark victory.
On the day before the Employment Equality (Age) Regulations 2006 came into force, the claimant was dismissed from her job. This decision to dismiss was as a result of a £32million overspend by the Trust and Southcott was among a group of around 30 employees who were all over 65 and dismissed prior to the Age Discrimination legislation coming into effect.
As a result of the decision, the Royal Cornwall Hospitals NHS Trust has agreed to reinstate Southcott with back pay from October 2006 and no loss of service.
